At the end of 2024, Lani (name changed) contacted a local partner agency seeking information about her legal rights after recognizing concerns in her relationship, including physical altercations, verbal and emotional abuse, intimidation, and economic abuse. As a new mother, her priority was protecting her child and understanding her options. She secretly attended the partner agency’s Family Law Clinic and consulted with a volunteer attorney regarding how to seek custody/visitation orders and the possibility of relocating with her child to be closer to her family and support system. For various reasons, Lani decided that at that time it was safest to remain in the relationship with Rob (name changed).

Unfortunately, over the coming months, Rob’s abuse continued to escalate. Rob made numerous threats and engaged in acts that caused Lani to fear for the physical safety of both her and the minor child. If Lani tried to advocate for herself or talked back, Rob’s aggression intensified and became even more dangerous.

Referral to CLA SoCal

About seven months later, Lani returned to the partner agency after leaving her partner. Shortly thereafter, Lani learned Rob had obtained a Domestic Violence Temporary Restraining Order (DVTRO) against her and temporary custody of their child based on false allegations of abuse against her. Rob was using the filing of a DVTRO to retaliate against her for refusing to reconcile their romantic relationship and to take away what mattered most to her: their child. The partner agency urgently referred Lani to CLA SoCal. After meeting with our family law attorney, Amy Abshier, CLA SoCal assisted Lani in filing her own restraining order request, and provided fierce representation in a highly contested, mutual restraining order Court hearing.  

Ultimately, Lani obtained a permanent restraining order against Rob and secured sole custody of her son. Rob’s DVTRO against Lani was dropped and his request for a permanent restraining order was denied. Our Family Law Unit continues to support Lani in her legal battle to obtain child support and request to relocate with her child. The partner agency has also continued to provide financial assistance for custody investigation, court fees, and storage costs, helping Lani and her child move toward safety and stability, underscoring the strong partnership and collaboration that CLA SoCal has with other DV organizations in Orange County.
