
Carlotta (fictitious name), a middle-aged woman with two minor children, came to us in need of a restraining order. Her husband Joey (fictitious name) was incarcerated in prison at the time but was soon to be released, and she needed assistance with the preparation of a request for a domestic violence restraining order (DVRO). I prepared the request and provided Carlotta with representation at the DVRO hearing, which had to be continued once to complete service to Joey in prison.
Just days before Joey was released from prison, we were able to get Carlotta what she needed and hoped—a five-year restraining order, which included the couple’s two children as protected parties. Further, the court granted her sole legal and physical custody with no visitation rights for Joey, who was ordered to enroll in a 52-week batterer program upon his release.
We are currently in the process of finalizing Carlotta’s default judgment for dissolution of her marriage, which we initiated as well. She is looking forward to being unencumbered by any ties to Joey and moving forward with her life.
